OK this is just a heads up for anyone having the same problem and only finding heaps for explanations and video showing how it should work.
So when i saw this post https://gitlab.com/inkscape/inbox/-/issues/7689 with the exact same issue and the solution actually being a linux mint issue and nothing to do with inkscape well happy days.
It seems linux mint 21.3 and other versions uses alt shift to drag and resize the open window. So you have to change that behavior if you want inkscape to have touch select.
(in short) it is a short cut setting in cinnamon Open the window settings on front menu -> behavior -> change the alt drag to disable, ctrl, super key and inkscape is happy
